These Terms of Use govern your use of positus.co, operated by Komorebi Labs, Inc. ("Komorebi," "we," or "us"). By using this website, you agree to these terms. If you do not agree, please do not use the website.

Purpose of the website

This website provides general information about Positus and a way for adult professionals to request a demonstration. Positus is in development. Descriptions of intended workflows do not guarantee general availability, compatibility, performance, or a release date.

A request for a demo is an inquiry only. It is not a purchase, an enrollment in a clinical service, or a guarantee of access. Any evaluation, subscription, clinical use, or other service will be subject to a separate written agreement and applicable product documentation.

Measurement and clinical judgment

Website content is not medical advice, a diagnosis, treatment, or return-to-sport clearance. It does not establish a clinician-patient relationship. Qualified professionals remain responsible for their own assessment and decisions, considering the full clinical context.

Illustrative curves, figures, and AI-generated scene imagery are explanatory material, not actual patient outcomes or evidence of clinical performance. Research on OpenCap or OpenSim does not establish that every Positus workflow has been clinically validated. References to institutions describe research lineage or historical experience, not endorsement.

No patient data through this website

Do not submit patient-identifiable information, health records, movement recordings, or other sensitive information using the website or demo email link. The site does not provide a patient portal or clinical upload service. Before any clinical data processing, the parties must agree on the relevant service terms, privacy and security requirements, and any required business associate agreement.

Acceptable use

You may use the website for lawful product research and business inquiries. Do not attempt to compromise its security, interfere with its operation, impersonate another person, send unlawful material, or violate another person's rights. Do not misrepresent the illustrative material as real clinical evidence.

Ownership and third-party references

Komorebi or its licensors own the website's content and branding, except material identified as belonging to others. You may view the site and share links for legitimate informational purposes. These terms do not grant a right to use Positus branding to imply affiliation or to reproduce protected content beyond what applicable law permits.

Open-source software is governed by its own licenses. Third-party names, publications, and links remain the property and responsibility of their respective owners. We do not control external websites or guarantee their content.

Availability and warranties

To the extent permitted by applicable law, the website and its informational content are provided "as is" and "as available," without warranties of accuracy, uninterrupted availability, fitness for a particular purpose, or noninfringement. We may correct, update, or remove website content. Mandatory rights and warranties that cannot lawfully be excluded are not affected.

Liability

To the extent permitted by applicable law, Komorebi will not be liable for indirect, incidental, special, or consequential losses arising from use of this informational website. Nothing in these terms excludes liability that applicable law does not allow to be excluded, or limits obligations in a separate agreement for a Positus service.

Privacy and communications

Our Privacy Policy explains the information handled in connection with this website and demo inquiries. The email link opens your own email app and lets you review the message before sending. The website does not enroll you in an SMS program or authorize marketing texts.

Changes and applicable law

We may update these terms and will post the revised effective date. California law governs these terms to the extent permitted by applicable law, without displacing any mandatory protections that apply in your jurisdiction. These terms do not impose mandatory arbitration or waive a right to bring a claim that cannot lawfully be waived.
